Terms of
Service

Effective October 15, 2026

These Terms of Service ("Terms") govern your use of this website and any session or service you book with Words by Whitney Consulting, operated by Whitney Fagan ("Words by Whitney," "we," "us," or "our"). By using this website or booking a session, you agree to these Terms. If you do not agree, please do not use the website or book a session.

1. Our services

We provide nonprofit formation consulting, grant readiness consulting, grant strategy, and grant writing services. Paid 1:1 sessions are 30-minute consultations held by video or phone at the time you book. Project work, such as formation support or grant writing, is scoped and quoted separately in writing before any work begins, and may be covered by a separate agreement.

2. Booking and payment

3. Rescheduling, cancellations, and refunds

4. Session credit

If you hire Words by Whitney for a paid project within 30 days of your session, the $47 session fee is credited toward that project. The credit applies once per session, has no cash value, cannot be transferred, and expires 30 days after your session date.

5. Included materials

Session materials, such as checklists and written summaries, are for your personal or your organization's internal use. You may not resell, republish, or distribute them without our written permission. All website content, including text, images, and design, belongs to Words by Whitney Consulting or its licensors.

6. No guarantee of results

We do not and cannot guarantee that you will receive grant funding, 501(c)(3) tax-exempt status, or any specific outcome. Funders make their own award decisions, and the IRS and state agencies make their own determinations. Timelines set by the IRS, state agencies, and funders are outside our control.

7. Not legal, tax, or accounting advice

Words by Whitney Consulting is not a law firm or a CPA firm. Our sessions, materials, and services are consulting and document preparation support only. They are not legal, tax, or accounting advice, and no attorney-client or accountant-client relationship is created. For legal or tax questions, please consult a licensed attorney or CPA.

8. Your responsibilities

You are responsible for the accuracy and completeness of the information you provide, for reviewing documents before they are filed or submitted, and for meeting your own filing and application deadlines. You are responsible for any government filing fees, such as IRS user fees and state fees.

9. Testimonials

Any testimonials or results shown reflect the experiences of individual clients. They are not typical and are not a promise of similar results.

10. Limitation of liability

To the fullest extent permitted by law, Words by Whitney Consulting and Whitney Fagan are not liable for any indirect, incidental, special, or consequential damages, or for lost funding, revenue, or opportunities, arising from your use of this website or our services. Our total liability for any claim related to a session is limited to the amount you paid for that session.

11. Third-party services and links

This website uses third-party services for scheduling, payments, and hosting, and may link to other websites such as IRS.gov or Grants.gov. We are not responsible for the content, policies, or availability of third-party services or websites.

12. Governing law

These Terms are governed by the laws of the state in which Words by Whitney Consulting is organized, without regard to conflict of law rules. Before filing any claim, you agree to contact us first so we can try to resolve the issue informally.

13. Changes to these Terms

We may update these Terms from time to time. The effective date above shows when they last changed. Continued use of the website or booking a session after a change means you accept the updated Terms.
